Terms of service
The terms under which Identity & Asset Guardian is provided.
1. Who we are
Identity & Asset Guardian is a digital identity and asset observation service operated by NanoCorp. These terms govern your use of this website and the services purchased through it.
2. What the service is
The service observes publicly available sources in relation to assets you declare and authorise, qualifies what it observes according to a stated evidence standard, and delivers a documented report. It is an observation and evidence service. It is not a security product for your own systems, it is not a legal service, and it is not a removal or enforcement service.
3. What you must provide
You must declare assets that are genuinely yours or your organisation's, and you must be entitled to authorise their observation. We rely on that declaration to scope the engagement, and we are not responsible for the consequences of an inaccurate declaration.
4. Scope and authorisation
Your declared asset registry is the authorisation scope of the engagement. We observe those assets and their public imitations. We do not extend scope without your recorded agreement.
5. Delivery
Turnaround times are stated per offer and measured from completed onboarding, not from payment. If we expect to miss a stated turnaround we will tell you before the deadline. An Action Pack requires a completed Evidence Assessment.
6. What we do not guarantee
We do not guarantee that any specific threat will be detected, that harm will be prevented, or that any content will be removed by a platform, registrar or other third party. We do not guarantee complete coverage of any source. The absence of a finding is not a warranty that nothing exists. “Detect. Prevent. Protect.” is a statement of purpose, not a guarantee.
7. No legal advice
Nothing in a report, an Action Pack or any communication from us is legal advice, and no finding is a determination that any conduct is unlawful. Legal determinations require your own qualified counsel.
8. No autonomous action
We do not submit reports, send notices, contact third parties or take any external action on your behalf without a specific written mandate from you for that action.
9. Prohibited use
You may not use the service to monitor, pressure, expose or harass an individual, to pursue assets you have no legitimate interest in, or for any purpose that would require unauthorised access to a system or a private space. We refuse such requests and may terminate an engagement that we determine is being used this way.
10. Payment and refunds
Prices are in USD and payment is processed by Stripe through the NanoCorp platform. Offers are delivered work rather than access to software. If we have not begun observation you may cancel for a full refund. Once a report has been delivered the fee is non-refundable, save where we have failed to deliver what the offer describes.
11. Continuous Guardian terms
Continuous Guardian is billed as a one-month term and does not renew automatically. A renewal link is sent before a term lapses. Monitoring stops at the end of an unrenewed term.
12. Liability
To the maximum extent permitted by law, our aggregate liability arising from an engagement is limited to the fees you paid for that engagement. We are not liable for indirect or consequential loss, including loss arising from a third party's decision to act or not act on a report.
13. Changes
We may update these terms. The version in force for an engagement is the version published when you paid for it.
